The EFF’s deep links section has posted a frightening draft of a Senate bill that would change the face of fair use forever.

Reviving the “broadcast flag” and seeking to go further by potentially “freezing” the definition of fair use, this new paradigm could literally poison device development in the United States. Boing Boing, as usual, has an excellent synopsis and commentary on the new bill.
Some days I’m optimistic for a bright, techno-enabled future where the consumer has immutable rights and content that wants a voice only has to ask. Days like this I’m more pessimistic, but no less vigilant.

I firmly believe that exposing people to the benefits and philosophy of open content is the method to raising public awareness about issues like this. As consumers and artists, it’s much easier for us to make informed and aware decisions when we are familiar with the alternatives and can clearly see the effects that stifling innovation could have.
